Terms of Service

These terms govern your use of marlowbags.com and any purchase you make through it. By placing an order you accept them. Please read them and keep a copy. They are written for sales to consumers in Australia.

Marlow Bags is a trading name of Takeover Enterprises LLC, a company incorporated in the State of Wyoming, United States of America. We sell online only. We have no shop or counter you can visit, and no telephone line; email is the only way to reach us.

2. Who may order

You must be at least 18 years old and able to enter a binding contract, and you must give us accurate delivery and contact details. We deliver to addresses in Australia only.

3. How a contract is formed

Our product pages are an invitation to buy, not an offer. Your order is an offer to buy. A contract is formed when we send you an email confirming that your order has been accepted or dispatched. If we cannot accept your order — the item is unavailable, we cannot deliver to your address, or the order looks fraudulent — we will tell you and refund you in full.

4. Prices and payment

All prices are in Australian dollars (AUD). Shipping is charged separately and is set out in full on our Shipping page and again with your order total before you pay. We add no further charges of our own after checkout.

You pay with the payment methods offered at checkout. Payment is taken when the order is placed. If a price on the website is obviously wrong, we will contact you before dispatch and you may confirm the order at the correct price or cancel it for a full refund; we will not simply charge you more than the price you agreed.

5. Description of goods

We describe our quilted bags as accurately as we can, including materials and measurements. Screens vary, so colours can look slightly different from the photograph. If an item is not as described, that is a failure of a consumer guarantee and our Returns and Refunds page tells you what happens next.

6. Delivery, title and risk

Delivery times are on our Shipping page and are estimates, not guarantees. Risk in the goods passes to you when the goods are delivered to the address you gave us. Title passes to you when we have received payment in full.

7. Cancelling and changing an order

Email support@marlowbags.com as soon as possible with your order number. If the order has not yet been prepared for dispatch we will change or cancel it and refund you in full. After dispatch, our Returns and Refunds page applies.

8. Returns

Our Returns and Refunds page forms part of these terms. It sets out your rights under the Australian Consumer Law and, separately, the change-of-mind returns we offer as a commercial courtesy.

9. Consumer guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law, including the guarantees of acceptable quality, fitness for purpose, correspondence with description, and clear title. Any part of these terms that would have that effect does not apply to you to that extent.

10. Our liability

Subject in every case to clause 9, and to the extent permitted by law, we are not liable for loss that was not reasonably foreseeable, for loss caused by events outside our reasonable control, or for business losses, and our liability for any other loss is limited to the amount you paid for the order concerned. Where the Australian Consumer Law applies and permits us to do so, our liability for goods is limited, at our election, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing any of those things. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

11. Using this website

Use the website lawfully. Do not attempt to interfere with it, scrape it at a scale that burdens it, or use it to defraud us or anyone else. We may suspend access to a customer who does. We do not warrant that the website will be available without interruption or free from errors.

12. Intellectual property

The text, photographs, design and trade marks on this website belong to Takeover Enterprises LLC or to our licensors. You may view and print pages for your own personal use. You may not copy them for commercial use without our written permission.

13. Third-party links

Where we link to another website, we do so for information. We do not control those sites and are not responsible for their content or their privacy practices.

14. Privacy

Our Privacy Policy explains how we handle personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, including the disclosure of your information to recipients outside Australia. It forms part of these terms.

15. Changes to these terms

We may change these terms. The version on this page when you place your order is the version that governs that order.

16. Complaints

Email support@marlowbags.com. We acknowledge complaints within 5 business days and answer in substance within 14 days. If we cannot resolve it, you may contact the consumer protection agency in your state or territory, or the Australian Competition and Consumer Commission at accc.gov.au.

17. Governing law

These terms are governed by the law of New South Wales, Australia, and you may bring proceedings in the Australian courts. Nothing in this clause takes away any right you have to bring a claim in the state or territory where you live, or to use an Australian consumer protection body.

18. General

If a clause of these terms is found to be unenforceable, the rest continues to apply. A delay by us in enforcing a term is not a waiver of it. You may not transfer your rights under these terms without our consent.
