Marlow Bags is a trading name of Takeover Enterprises LLC, a company incorporated in the State of Wyoming, United States of America. We sell online only. We have no shop or counter you can visit, and no telephone line; email is the only way to reach us.

Takeover Enterprises LLC is the entity responsible for the personal information collected through this website. We are established outside Australia and we sell to customers in Australia. Whatever the technical reach of the Act over a company our size, we handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and the sections below follow those principles one by one.

APP 1 — Open and transparent management of personal information

We keep this policy current and free to read on our website. If you would like it in another format, email support@marlowbags.com and we will send it to you.

APP 2 — Anonymity and pseudonymity

You can browse this website without telling us who you are. You cannot place an order anonymously: to deliver goods we need a name and a delivery address, and to answer a support email we need an email address.

APP 3 — What personal information we collect

  • Order and contact details: your name, delivery address, billing address, email address and, if you give it, a phone number for the carrier.
  • Payment information: your payment is processed by the payment providers available at checkout. We receive confirmation that a payment succeeded and a masked reference. We do not collect or store your full card number.
  • Order history: what you bought, what you returned, refunds, and the messages you exchange with us.
  • Technical information: IP address, device and browser type, pages viewed and similar website usage data collected through cookies and similar technologies.

We do not ask for and do not want sensitive information as defined in the Privacy Act (for example health, racial or ethnic origin, political or religious information). Please do not send it to us.

APP 4 — Unsolicited personal information

If we receive personal information we did not ask for and could not lawfully have collected, we destroy or de-identify it as soon as it is lawful and reasonable to do so.

APP 5 — Notice of collection

We collect personal information directly from you when you place an order, create an account, subscribe to our emails or contact us. We also receive information from our store platform and payment providers about transactions you make. This policy is the notice required by APP 5.

APP 6 — How we use and disclose personal information

We use your personal information to take and fulfil your order, arrange delivery, process refunds and returns, answer your messages, keep accounting and tax records, prevent fraud and abuse, and improve the website. We disclose it only to the categories of recipient we need to use to do those things:

  • Shopify, which hosts this store and processes orders on our behalf.
  • The payment providers offered at checkout, which process your payment and carry out their own fraud and anti-money-laundering checks.
  • Our fulfilment partner and the carriers that dispatch and deliver your parcel.
  • Our email, support and analytics providers.
  • Professional advisers, and government or law enforcement bodies where we are required or authorised by law to disclose information.

We do not sell your personal information, and we do not disclose it for another organisation's own marketing.

APP 7 — Direct marketing

We send marketing email only where you have asked for it or where you have bought from us and would reasonably expect it. Every marketing email has a working unsubscribe link, and you can also ask us to stop at any time by writing to support@marlowbags.com. We will act on the request promptly and at no cost to you, and on request we will tell you where we got your address.

APP 8 — Cross-border disclosure of personal information

Your personal information is disclosed to, and stored on, servers and by parties located outside Australia. This is unavoidable in our case: the entity behind this store is a United States company and the store platform, the payment providers and the fulfilment chain are all overseas. The countries currently involved are:

  • United States — Takeover Enterprises LLC itself, and our store platform, email and analytics providers.
  • Canada — Shopify Inc., which operates our store platform.
  • Mainland China — the warehouse of our fulfilment partner, which receives your name, delivery address and, where the carrier requires it, your phone number, for the sole purpose of addressing and dispatching your parcel.
  • Other countries where a payment provider you choose at checkout processes transactions.

We take reasonable steps to ensure these recipients handle your information in a way consistent with the Australian Privacy Principles, through the contracts we have with them and by giving them only the minimum information they need. You should be aware that overseas recipients are not always subject to the Privacy Act, and that the privacy laws of those countries differ from Australia's. If you are not comfortable with this, please do not place an order.

APP 9 — Government related identifiers

We do not adopt, use or disclose government related identifiers such as a tax file number, Medicare number or driver licence number as our own identifier for you. We do not need them and you should not send them to us.

APP 10 — Quality of personal information

We rely on the details you enter at checkout. Please check your delivery address before you pay. If something is wrong, email support@marlowbags.com with your order number and we will correct it if the parcel has not yet been dispatched.

APP 11 — Security, and the Notifiable Data Breaches scheme

We take reasonable steps to protect personal information from misuse, interference and loss and from unauthorised access, modification or disclosure: encrypted connections to the website, access limited to the people who need it, and providers chosen for their security practices. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. We destroy or de-identify personal information when we no longer need it and no law requires us to keep it.

If a data breach occurs that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act 1988.

APP 12 and APP 13 — Access to, and correction of, your information

You can ask us for a copy of the personal information we hold about you, and you can ask us to correct it if it is wrong, out of date, incomplete or misleading. Write to support@marlowbags.com. We will respond within 30 days. Access is free; we will tell you in advance if a request is so large that a reasonable cost applies. If we refuse access or refuse to make a correction, we will tell you in writing why, and how to complain.

Automated decision-making

Our store platform and our payment providers apply automated fraud-risk scoring to orders. We do not refuse or cancel an order on the strength of that score alone — a person looks at the order first. We do not use personal information in automated decision-making that could reasonably be expected to significantly affect your rights or interests. New transparency obligations about automated decision-making (APP 1.7 to APP 1.9, inserted by the Privacy and Other Legislation Amendment Act 2024) commence on 10 December 2026; if our practices change we will update this policy before then.

Cookies and similar technologies

We use cookies that are strictly necessary to make the shop work — keeping your cart, keeping you signed in, and security. We also use analytics and, where you consent to it, advertising cookies that help us understand how the shop is used and measure our advertising. You can block or delete cookies in your browser settings; if you block the necessary ones, checkout will not work.

How long we keep your information

Order, payment and tax records are kept for as long as accounting and tax law requires. Support correspondence is kept while it may still be relevant to your order or a return. Marketing contact details are kept until you unsubscribe.

Children

This shop is not intended for children. We do not knowingly collect personal information from anyone under 18. If you believe we have, email support@marlowbags.com and we will delete it.

Complaints about privacy

If you think we have breached the Australian Privacy Principles, please tell us first. Email support@marlowbags.com with the word "Privacy complaint" in the subject line and set out what happened. We will acknowledge your complaint within 5 business days and give you a written answer within 30 days.

If you are not satisfied with our answer, or we do not respond within 30 days, you can take the complaint to the Office of the Australian Information Commissioner (OAIC), the independent privacy regulator: oaic.gov.au, or telephone 1300 363 992. The OAIC normally expects you to have complained to us first and to have given us 30 days to respond.

Changes to this policy

We may update this policy to reflect changes in our practices or in the law. The current version is always on this page with the date below.
